This morning, May 4, 2016, the TCEQ issued a letter to all parties in the Pintail Landfill, LLC MSW No. 2377 landfill application matter stating that the TCEQ no longer has jurisdiction to act on the application.

As you will recall, Pintail had recently, on April 8, 2016, submitted a Motion for Commission Review and Reversal of the Executive Director’s Staff’s Purported Return of Its MSW Landfill Application, challenging the authority of the Executive Director to return the application, which he did back on October 5, 2015. This motion was filed some five months past the deadline for Pintail to file a Motion to Overturn the Executive Director’s action, and Pintail did not appeal to the district court.

This morning’s letter, signed by TCEQ’s general legal counsel, confirms that the TCEQ no longer has jurisdiction to act on the matter.
