CITIZENS AGAINST THE LANDFILL IN HEMPSTEAD’S INITIAL COMMENTS ON THE APPLICATION OF PINTAIL LANDFILL FOR A LAND USE COMPATIBILITY DETERMINATION, TCEQ PROPOSED MSW PERMIT NO. 2391

COMES NOW, Citizens Against the Landfill in Hempstead (“CLAH”), and files these Initial Comments on Pintail Landfill, LLC’s (“Pintail” or “Applicant”) Application for a Land Use Compatibility Determination, Texas Commission on Environmental Quality (“TCEQ”) Proposed MSW Permit No. 2391 (“2016 Application”). The 2016 Application seeks a separate land use only compatibility determination from TCEQ regarding a proposed municipal solid waste, special waste, and Class 2 and 3 industrial waste management facility located approximately 860 feet east of State Highway 6 between Wendt Road and Kelley Road, which is approximately 1 mile North of US Highway 290 in Hempstead, Waller County, Texas 77445. These initial comments relate only to the threshold issue of whether the location of the proposed facility is barred by local ordinance of the City of Hempstead (“City”) and/or Waller County (“County”). CALH reserves the right to submit further comments relating to this and all other issues.
